LAHORE:
The Border Area Committee submitted to Justice Umar Ata Bandial of the Lahore High Court on Friday that an NOC (no objection certification) from the General Headquarters was required to sell and purchase land allotted to military officers near the border.
The court was hearing a petition on the subject of not issuing NOCs for the sale and purchase of land near border areas. The court had previously ordered the committee to evolve rules and regulations for the sale and purchase of land within five kilometres of the Pak-India border line. Advocate Amir Chohan, representing the Border Area Committee, submitted a report on the rules. He said the GHQ had approved the rules recommended by the committee. The court recorded his statement and adjourned hearing for an indefinite period.

They are taking decision based on new rules, where they have addressed number of Violations as indicated by Lahore High Court but still one of the clauses is not in accordance to courts original rulings. That is if one has sold a portion of land earlier then the land sold will be cancelled and original owner who made the violation, same portion of land still held in his account will be cancelled. Which implies the original allot-tee who sold entire his land earlier has nothing to lose and it’s a win situation for him. Emphasis is on cancelling the land as they cannot forgive that and main reason is that no more land is left to be allotted. They want to cancel the land, re-allot to their names and sell it within days to invest somewhere earlier as they know that the case will go into high court and eventually a stay order will be issued and finally original allottee will win as it’s just a matter of time. they say the new rules are in accordance with court rulings whereas court earlier said that they should forgive the lapse and start things from fresh light as their policies were the one which had flaws and weaknesses and were questionable rather than the allot tees.
You have said he words right and exact. To this day they have not given NOC to many people and forcefully cancelling the allotments by the hundreds.
