The Uttar Pradesh government has decided to withdraw the sedition case against Kashmiri students for allegedly celebrating Pakistan’s victory over India in a cricket match on March 1, Express News reported.
Uttar Pradesh government had earlier filed a sedition case against these students from Kashmir under Section 124a, 153a and 427 of the Indian Penal Code. According to Section 124a, whoever excites or attempts to excite disaffection towards the Indian government shall be punished with imprisonment or with a fine.
Earlier, Swami Vivekanand Subharti University (SVSU) in Meerut, Uttar Pradesh had suspended the students for celebrating Pakistan’s victory.
“The SVSU administration on Wednesday submitted a written complaint against unknown persons for indulging in anti-national activities and creating a ruckus on the university campus,” Meerut police chief Omkar Singh told AFP.
“We have registered a case and the probe is on,” Singh explained.
“If evidence is established against the accused, there is a set legal procedure to be followed in such cases. The law will take its own course,” he said, adding that any charges would be ones of sedition.
Pakistan’s foreign office spokesman said sedition charges against the students would be “very unfortunate”.
“If the Kashmiri students want to come and pursue their education in Pakistan, our hearts and academic institutions are open to them,” Tasnim Aslam told reporters in Islamabad.
According to the Hindustan Times, trouble began on Sunday night, when a group of local and Kashmiri students were watching the India-Pakistan cricket match in the hall of the hostel. A few Kashmiri students cheered every time an Indian player’s wicket fell, later celebrating Pakistan’s win.
LUCKNOW: Vice-chancellor of Swami Vivekanand Subharti University Dr Manzoor Ahmad said he was taken aback by such a gesture by the students.
“Some students complained that a few students reportedly shouted Pakistan zindabad while going to their rooms,” said Ahmad.
He said the authorities initially decided to suspend only those students who had chanted such slogans.
Well it is so heartening to know that most Muslims in India support Pakistan. Pakistan Zindabad !!!

The government of India, college and the mostly-Hindu taxpayers had been funding their entire expenses in the engineering college for education, boarding, lodging and even train/bus fair to and from their home in valley. There are still more than 200 Kashmiri Muslim students who are still in the college and safe.
They should be thankful that the management had provided than buses and police escort to leave the area safely.
These are misguided youth. They should “introspect” that they are on full scholarships for professional expensive courses provided by the Indian prime minister.

Chapter VI of the Indian Penal Code (IPC) deals with “offences” against the State. Section 124A of the IPC defines Sedition as follows:- Whoever by words, either spoken or written, or by signs, or by visible representation, or otherwise, brings or attempts to bring into hatred or contempt, or excites or attempts to excite disaffection towards the Government established by law in India, shall be punished with imprisonment for life, to which fine may be added, or with imprisonment which may extend to three years, to which fine may be added, or with fine.
Right to Freedom of Speech and Expression vis-à-vis Sedition
Article 19(1)(a) of Indian Constitution says that all citizens have the right to freedom of speech and expression. The right to freedom of speech and expression incorporates protection for austerely censuring existing government structures, policies, and administrative schemes, coupled with protection for suggesting and recommending the development of other system. Article 19 (2) of Indian Constitution says that, every citizen of the country holds the right to air his or her opinion through the printing or the electronic media with restrictions imposed.
supporting any team or even chanting Pakistan Zindabad alone is not an attempt to excite disaffection towards the government.. The Muslim Vice chancellor of the University might have felt that such action of Kashmiri students might create some sort of dis harmony and / or may lead to communal tension and appeared to be over enthusiastic. i feel the students’ suspension will be withdrawn.The matter should have been handled with maturity.

If filing of Sedition case means “go to Pakistan” at least 19 people of Times of India (ToI) Ahmedabad should have been kicked out of India! Look at the legal tyranny of Gujarat: During May 27:June 1 ’08: TOI carried investigative reports on Police Commissioner Mathur’s dubious background and questioned if Ahmedabad was safe in his hands. On June 1 ‘ 08 : Mathur lodged first FIR against TOI for sedition. In all 19 cases were filed. Sedition case was slapped with oral consent of the chief minister and home minister Narendra Modi and MoS for home Amit Shah. But truth prevailed & on Apr 18 ’12 : Gujarat high court quashed sedition case against TOI, Ahmedabad

Lets’s get this right before you put up this cheeky little comparison here. The ones supporting Pakistan at the Indian University are “Kashmiris” and not Indians. So your comparison of Pakistani Hindus cheering for India does not really make sense here. Kashmiris do not want to be part of India, they never did! They want Kashmir to be independent of the Indian rule and they have their sympathies with Pakistan. Pakistani Hindus have no such claims of separation from Pakistan. They are our citizens and go freely between Pakistan and India as they desire.

I am against the sedition charges being filed. They have a right to expression that includes right to dissent. @Indian reader: Did India win the world cup after defeating Pakistan?. It was only on one occasion, that too at home, that India won the world cup after beaating Pakistan in the semi finals. Although Pakistan lost to India in world cup but on one occasion Pakistan won the world cup (1992) and on one occasion (1999) was runner up when Austaloa emerged champions. On the aggregate Pakistan leads the number of wins against India outside world cup.

I was watching this match in a screening party in islamabad where few guys were openly supporting and cheering for India specially in most heated moments (for unknown reasons) but it didn’t create any bad taste instead it added more fun to it as we found some opposition in them

The students should not have been detained and suspended for 3 days. What happened was not right and there has been sufficient outrage/protest for this action in India including the CM of J&K personally talking to the CM of UP to look into this issue.
What also happened was that 3 people died in Karachi in celebratory gun-shots after Pakistan won the match. However there has been literally no protest/outrage for this from any Pakistani.
In my view 3 ppl dying is a much more grave issue than students being detained/suspended.
Pakistan should really look into the problems faced by their country rather than having the schadenfreude at the relatively smaller issues faced by their neighbor.
I commend the Kashmiris for standing up to suppression and injustice brought upon by the Indian tyranny

I have no disagreement with your exhortation of ‘Pakistan Zindabad’. But how did you conclude from this that ‘Most’ Muslims support Pakistan vis-a-vis India? This event was clearly unusual enough to draw attention.
One other thing that proves is that Kashmiri students have all the opportunities to study anywhere in the country and are hardly the oppressed individuals that Pakistani media portrays them as – because clearly they were studying in UP not Kashmir.
finally, this sedition trial will go nowhere and the men will be acquitted as they should be. This is nothing but an election trip by Samajwadi Paty who has been getting heat for its overt appeasement policies towards Muslims and now wants to tilt the balance. How so? Did the court convict them? Did the court even indict them? No. This means nothing other than Samajwadi Party is trying to correct its ongoing tilt towards Muslim leadership through overt appeasement. But they are trying to correct one wrong by another wrong. This is a stupid idea and people should be able to openly support whichever team they like.
Yes it is disappointing that these boys are taking all advantages of being Indian students and studying in UP but are still supporting Pakistan. But there is a big difference between disappointment and sedition.

Before partition India, Pakistan and Bangladesh were one and united celebrating each others win is OK and should not be taken seriously. How many ever wars we may have fought or how much ever the enmity be between us there is always Aman Ki Asha. I know many in Pakistan who celebrate India winning and many Indians celebrate Pakistanis winning. Conservatives on both side create wall but the liberals create bridges. Liberals on both sides enjoy the victory of India, Pakistan, Bangladesh or the British. We are all one and we all friends living on the same planet mother earth. This might be an unpopular opinion, but as a Pakistani I am quite sick of this Kashmir issue being one of the choke points in Pak-India relations. There are people struggling under political and economic limitations all over the world including overwhelmingly in my own country, why my countrymen care especially for kashmiris in this respect is beyond me; just because they are muslims. I for one do not and I hope there are many more Pakistanis like me that share this opinion.
These kashmiri students as pointed out above were studying on full scholarships given out by the Indian Government, why bite the hand that feeds? More importantly they should be more sensitive about the things they say; they are at an Indian University spouting pro-Pakistan slogans. That is beyond stupidity and the height of irresponsibility, they deserve to get suspended.

Indeed it does. The CM of the state that the boys were from spoke up in their favior. The government of India withdrew the case which had no merit. Even if it had not done so, the court would have trown it out. When it has acquitted Geelani of sedition charges despite his fiery anti-india speeches – where is the question of convicting these boys?
This indeed is how a democracy works i.e. if some overzealous lower level person makes a bad decision, there are enough corrective mechanism in place.

I found this line interesting: “Vice-chancellor of Swami Vivekanand Subharti University Dr Manzoor Ahmad said he was taken aback by such a gesture by the students.”
So, the VC of this university is a muslim, very likely a non-kashmiri muslim who was surprised, like most others, at the attitude of the kashmiri youth.
These Kashmiri students should be allowed to go to Pakistan to pursue further studies. They have no future in India.
India’s getting a black eye everywhere one looks these days. Whether it’s Wendy Doniger, or such stupid acts by charged up police, Indians that care about their country shouldn’t be defending these acts. Because it’s under such a spotlight, esp. with the rise of Mr. Modi, Indians need to show the world they really are who they say they are. Unfortunately, many Indians on this comment line don’t share this point of view. It’s time for the secular, liberal India to stand up, or the lunatic right will totally take over the narrative.

My! My! Hasn’t Pakistan already opened the doors the madrassas and camps being run by the likes of LeT and JeM under state patronage to all and sundry from all over the world? Kashmir belongs to India, Pakistan can try its best, it wont get anything. You have been trying for over 60 years now, but like everything else, you failed at this too. In the process of trying to get Kashmir, you lost Bangladesh. First learn to control your own territory, then dream of invading. Balochis dont want to be a part of Pakistan either, why are you not letting them form their own country?
Any Kashmiri who is Pro Pakistani should be in Pakistan, thats the right place to celebrate Pakistan victories. This Pakistani dream to capture Kashmir, disguised as “Azaadi” for Kashmiris, will fail like every other sinister Pakistani ambitions.
When one does not have any achievements of their own to celebrate, they celebrate other’s failures, hence a failed state like Pakistan, whose only role in this world is to breed jehadis (who btw are now killing more Pakistanis than any other nation) celebrates when something goes wrong in India. India foolishly made a mistake of slapping sedition charges on those idiotic students, but India has the ability to correct itself too, and withdrew the charges too. That is the power of democracy, where citizens can be critical of its nation, and force it right its wrongs. In Pakistan, response to a pro India celebration would have been suicide bombing. Your nation is yet to realize its mistakes of using terrorism to capture Kashmir, now that same terror is haunting you and has come back to bite you.
@Imran Umaid : Bhai there is difference between Pak-Eng, Ind-Eng relations and Ind-Pak relations. If in Pakistan, someone says Pakistan murdabad infront of you, I am pretty sure your blood will boil too. Also, the students in UP university were not expelled, but suspended for their own safety, as they would be easily outnumbered by the other students. Sedition charges were foolish, I am glad they were withdrawn

RSS is not apolitical party and does not need votes. BJP does not rule UP where this incident occurred. If you are an Indian as you claim to be in your posts – I am surprised that you were not aware that it is Samajwadi Party which has a reptation of appeasing the mullahs which was in power in UP.

Please show me any election where anti-Pakistan slogans got votes for a party. This did not even happen in 2009 elections which were soon after 26/11 where the ruling UPA had taken a very soft stance with Pakistan.

It has given Pakistani a good handle to deride India, but the fact of the matter is that it was a local level situation when in a nail baiting situation supporters of two team got engaged violently and the local authority to pacify the situation took some action.This could happen even when the warring faction here where not supporter of India or Pakistan team.This issue was flared up by the media in different color to attract the viewership.
So how many Pakistani would be ok if baloch in karachi or lahore or quetta start cheering up for Indian team against Pakistan ?

In 2007 I had the pleasure of being the only Pakistani in a crowd of over a 100 Indians watching a tense Pak vs India game in a sports bar in one of Mohali’s famous Hotels. On every Pakistani four or six hit, i would be off my feet and applauding. On every Indian wicket that fell i would be doing the bhangra. I got a lot of cold stares right until the final moment when we won the match but not once was i asked my nationality or where i came from. Narrow mindedness is an individual sickness of the mind, let us not brand a entire country with it on religious and political grounds. The sedition case was an act of impulse and yes a stupid one but having said that it has since been withdrawn. Let us be gracious in our victory by not ranting it in the oppositions face.
I am concerned about their safety and security in future.

everyone knows here that majority of kashmiri people are still connected directly or indirectly with pakistan …….but by doing so i don’t think they are doing any
act of sedition , treason etc…..these are natural instincts…history , culture, geography there are several reasons..
But when they are away from kashmir they should know the situation and act accordingly … if they have sympathy its ok but they should understand that people from other part have different perception….
